A fair and efficient handling of petition is related to your legitimate rights and interests. Please read the following notice about petition carefully.
1. Please Understand the Scope of Petition
1.1 Criticisms, suggestions and opinions on the work of the court;
1.2 Complaint, accusation or prosecution of the illegal, disciplinary and delinquent behavior of the staff of the court.
Note: If the litigant inquiries about the handling of the case or has opinions on the handling of the case, it shall be dealt with in accordance with the statutory lawsuit and the relevant provisions. For example, if the case is being heard in our court, the petition staff will transfer the relevant materials to the case management department of the court; for cases that are not part of our court: for matters relating the litigation, which involve prosecution and meet the conditions for filing a case, you should file a suit with the Peoples’ Court with jurisdiction; for cases involving an appeal and in the appeal period, you shall appeal to the court in accordance with the legal procedures, for cases involving a petition or application for retrial, which meet the conditions for admissibility, you shall file a petition or apply for retrial in accordance with the legal procedures.
2. Please Follow the Procedure below to Handle Petition
2.1 Means of submitting a petition in the court includes letter handling visiting reception, telephone answering, online petition and so on. Litigation service center of the First International Civil and Commercial Court of Hainan set up a petition window.
2.2 Petition information registration. You shall inform the petition staff of the court with the latest communication address and contact information when you write or call and register the petition information so that the reception staff can give you timely feedback on the situation and if there are any change in the communication address, it should be revised and corrected in time; when visiting, you should fill in the registration form; if you apply for the online petition, you shall log in the online petition system of the First International Civil and Commercial Court of Hainan and link it to the petition system of this court and fill in the relevant content according to the system prompt.
2.3 Processing results. All kinds of petitions in the court will be reviewed, screened and distributed. For matters of visiting, an immediate response will be given; if an immediate response cannot be given, it will be given within a reasonable reply period.
3.The Following Situations Will/Cause your Petition to Be Inadmissible
3.1 If your petition has been accepted or is being processed and you apply for another on the same issue within the prescribed period;
3.2 If your petition has been concluded, you make a request based on the same circumstance and cause.
4. Please Pay Attention to the Handling of Illegal Petition
If you carry out the following acts of disrupting public order during the petition,you and offensive will be published by the public security body in accordance with the relevant law and regulations. If a crime is constituted, you shall be held criminally responsibility in accordance with the law.
4.1 Unlawful gathering, stranding and encircling of the entrances and exits at the office of state organ and its surrounding area, important places and key areas of traffic flow during the period of the important activities;
4.2 Stranding and occupying the petition reception place or abandoning those who are young, ill, disabled or unable to be self-reliant at the reception site;
4.3 Intercepting or forcibly boarding a motor vehicle, which affects the normal driving vehicles or blocks the road or traffic, or disrupts other traffic order;
4.4 Illegal carrying of dangerous goods such as guns, ammunition, control instruments and explosives, highly toxic substances, inflammable and explosive articles, radioactive article and infectious articles;
4.5 Threatening the personal safety of the relevant bodies staff and their family members, illegally restricting the personal freedom or injuring others such as tangling, insulting, besieging, beating the relevant unit staff, or threatening to murder, kidnap, set fire, blow, set off dangerous goods and so on;
4.6 Intentionally damaging public facilities, public property and property of other people;
4.7 Disseminating information that disturbs public order and undermines social stability;
4.8 Obstructing or interfering with normal activities of enterprises and institutions such as production,work, teaching and scientific research;
4.9 Other acts that seriously impede the social public order and the legitimate rights and interests of others.
